Products liability refers to a broad area of the law that is designed to allow those who have suffered injury or financial loss due to a defective product to seek compensation. At Law Advocate Group, we will assist you in determining the merits of your case and then plan a legal course of action in recovering damages. Our firm pursues both strict and negligent products liability claims.
Products liability can occur in cases involving food and beverages; motor vehicles and accessories; aircraft and boats; industrial, business, or farm machinery, tools, and equipment; paint, cement, building supplies, small tools, and ladders; toys, games, and sports equipment; household and domestic machinery and appliances; clothing and shoes; animal medicines, fertilizers, pesticides; containers and packaging materials; and prescription or over-the-counter drugs.
A successful products liability claim may be based upon a defective product design, a manufacturing defect, or marketing defects such as inadequate labels or warnings. Manufacturers and suppliers are liable for these three types of product defects.
Design defects are defects in a product that occurs when the manufacturer could have reduced or avoided a foreseeable risk of harm by adopting a reasonable alternative design that would have made the product reasonably safe.
Manufacturing defects are defects in a product that depart from its intended design even though care was exercised in its assembly.
Marketing defects occur when a manufacturer or supplier fails to adequately warn of a product’s potential risk of harm that is known or should have been known about a product or its foreseeable use.
One should seek appropriate medical care and then take steps to preserve evidence. Hold on to the product and any receipts, manuals, or other information relating to the product or its purchase. Take photographs of the product and damage. Write down the contact information for any witnesses.
If you or someone you know has a products liability claim, contact Law Advocate Group to review your case and advise you accordingly.
